In view of the unclear ownership of premarital property gains in our current laws,the author,by using analysis method, points out that the ownership of property should be determined according to whether the income relates to marketing operations and that different kinds of ownership should be distinguished.
针对中国现行法律对夫妻婚前财产收益的归属规定不明确这一问题,运用分析的方法,提出依据收益是否涉及经营行为来确定其财产所有权归属,对于不同类型的财产收益应该有所区别的观点。
